Ticket Terms, Conditions, Assumption of Risk and Release of Liability

PLEASE READ CAREFULLY. THESE TERMS AFFECT YOUR LEGAL RIGHTS AND INCLUDE AN ASSUMPTION OF RISK AND A RELEASE OF CERTAIN CLAIMS, INCLUDING CLAIMS BASED ON ORDINARY NEGLIGENCE.

Acceptance of Terms

TERROR FALLS is a seasonal drive-through Halloween attraction operated by Paradise Falls Car Wash, LLC (the "Company"). In these Terms, "Event" means TERROR FALLS and all related parking, queueing, loading, attraction, car-wash, and exit areas; "you" means each ticket purchaser, driver, passenger, and other attendee; and "Released Parties" has the meaning stated in the Release of Liability section below.

By purchasing or accepting a ticket, clicking to accept these Terms, presenting or scanning a ticket, entering the Event property, entering the attraction, or participating in the Event, you acknowledge that you have read and understood these Terms and voluntarily agree to be legally bound by them. If you do not agree, do not purchase or accept a ticket, enter the Event property, or participate in the Event.

Event Warning

TERROR FALLS is an intense, immersive Halloween attraction intentionally designed to frighten and startle guests. The Event may include, without limitation:

  • loud or sudden noises, amplified sound, alarms, screams, horns, and strong sound effects;

  • sudden scares, live actors, close performer interaction, startling movements, and frightening visual or audio experiences;

  • darkness, low visibility, confined or enclosed environments, emergency lighting, and rapidly changing light levels;

  • strobe lights, flashing lights, lasers, ultraviolet lighting, and other theatrical lighting effects;

  • fog, theatrical haze, mist, water, bubbles, scents, and airborne or surface special effects;

  • moving props, animatronics, mechanical equipment, car-wash equipment, and special effects;

  • wet, slick, uneven, sloped, obstructed, or changing pavement and walking surfaces;

  • other vehicles, vehicle movement, vehicle loading or unloading, queues, and interaction with other guests; and

  • weather conditions, insects, allergens, smoke-like effects, and other conditions inherent in an outdoor or live drive-through attraction.

Participation is voluntary. The Company cannot guarantee that every effect, condition, or risk will be identified in advance.

Assumption of Risk

You knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, arising from or related to traveling to, entering, attending, or participating in the Event. These risks include, without limitation:

  • fear, anxiety, panic, shock, emotional distress, startle reactions, disorientation, or aggravation of a psychological condition;

  • slips, trips, falls, collisions, contact with equipment or objects, and injury caused by darkness, low visibility, wet surfaces, moving equipment, performers, other guests, or vehicles;

  • allergic reactions, respiratory distress, seizures, illness, medical emergencies, bodily injury, permanent disability, or death;

  • loss of or damage to clothing, electronic devices, personal property, or vehicles;

  • acts or omissions of other guests, drivers, passengers, vendors, contractors, or third parties; and

  • other risks inherent in a live, drive-through haunted attraction and car-wash environment.

IMPORTANT: SERIOUS INJURY, MEDICAL EMERGENCY, PROPERTY DAMAGE, OR DEATH MAY RESULT FROM RISKS ASSOCIATED WITH THE EVENT. YOU VOLUNTARILY CHOOSE TO PARTICIPATE DESPITE THOSE RISKS.

Medical and Sensory Warning

Do not participate if you have, may have, or are experiencing a physical, medical, psychological, or sensory condition that could be triggered or aggravated by the Event. Conditions of particular concern include, without limitation:

  • heart disease, high blood pressure, or another cardiovascular condition;

  • asthma, breathing difficulty, allergies, or another respiratory condition;

  • pregnancy;

  • epilepsy, seizures, photosensitivity, migraines, or sensitivity to strobe or flashing lights;

  • severe anxiety, panic disorder, post-traumatic stress disorder, claustrophobia, or sensitivity to frightening or startling environments;

  • a recent injury, surgery, mobility limitation, or condition affecting balance; or

  • any condition for which a medical professional has advised you to avoid intense, frightening, loud, dark, enclosed, flashing-light, fog-filled, or drive-through attractions.

You are solely responsible for deciding whether you and any minor in your care are medically and physically able to participate. The Company and Event staff cannot evaluate your fitness to participate or provide medical advice. If you are uncertain, consult a qualified medical professional before attending.

Release of Liability

RELEASE OF CLAIMS, INCLUDING ORDINARY NEGLIGENCE. TO THE FULLEST EXTENT PERMITTED BY GEORGIA LAW, YOU VOLUNTARILY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE THE RELEASED PARTIES FOR CLAIMS ARISING OUT OF OR RELATING TO YOUR PRESENCE AT OR PARTICIPATION IN THE EVENT, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY.

The "Released Parties" are Paradise Falls Car Wash, LLC; TERROR FALLS; and each of their past, present, and future owners, members, managers, officers, affiliates, related entities, sponsors, venue owners, landlords, property owners, employees, independent contractors, performers, volunteers, vendors, licensors, advertising and promotional partners, insurers, successors, assigns, representatives, and agents.

This release applies to claims, demands, actions, causes of action, liabilities, damages, losses, judgments, costs, and expenses arising from personal injury, illness, emotional distress, death, property loss, vehicle damage, or other harm, including claims alleging negligent acts or omissions, negligent operation or maintenance, unsafe premises conditions, negligent supervision, or failure to warn.

This release does not apply to gross negligence, willful or wanton misconduct, intentional misconduct, or any duty or liability that cannot lawfully be released or waived under applicable law.

Vehicle and Driver Responsibility

The driver is solely responsible for the lawful and safe operation, condition, and control of the vehicle. The driver represents that they possess a valid driver's license, are capable of safely operating the vehicle, are not impaired by alcohol, drugs, fatigue, or distraction, and are operating a properly maintained and insured vehicle.

Drivers and occupants must:

  • follow all posted signs and all instructions from Event staff, including directions about speed, spacing, stopping, braking, steering, gear selection, conveyor loading or unloading, and exiting;

  • maintain full control of the vehicle except when Event staff instruct the driver to place the vehicle in a specified gear or allow equipment to move it;

  • remain on the designated route and maintain a safe distance from people, props, equipment, and other vehicles;

  • keep every occupant inside the vehicle, seated, and properly restrained when required by law or staff instructions;

  • keep all doors, windows, sunroofs, liftgates, trunks, and other openings closed and secured unless Event staff expressly instruct otherwise;

  • secure or remove loose, aftermarket, damaged, non-factory, or externally mounted items before entry;

  • not use a handheld phone, camera, or other device while driving; and

  • immediately obey any instruction to stop, exit, shut off the vehicle, activate hazard lights, or take other emergency action.

To the fullest extent permitted by law, the Released Parties are not responsible for vehicle damage, mechanical failure, collision, or other property damage caused by driver error, failure to follow instructions, failure to secure the vehicle or its components, pre-existing damage or defects, loose or aftermarket parts, the acts of another guest or third party, severe weather, utility failure, or circumstances beyond the Company's reasonable control. This paragraph does not expand the release beyond what Georgia law permits.

Personal Property

You are responsible for securing all personal belongings before entering the Event. To the fullest extent permitted by law, the Released Parties are not responsible for personal property that is lost, stolen, misplaced, wet, soiled, or damaged during or in connection with the Event.

Guest Conduct and Safety Rules

Guests may not:

  • exit a vehicle except when directed by Event staff or when reasonably necessary during an emergency;

  • touch, grab, strike, threaten, harass, or interfere with performers, staff, other guests, props, scenery, animatronics, equipment, or vehicles;

  • throw objects, discharge sprays, use lasers, or bring or display weapons or realistic weapon replicas;

  • use abusive, discriminatory, obscene, or threatening language or engage in fighting, reckless driving, horseplay, or unsafe conduct;

  • smoke, vape, ignite any flame, or possess or use illegal drugs at the Event;

  • enter or remain at the Event while impaired or visibly intoxicated;

  • intentionally damage or deface property; or

  • disregard posted rules, safety warnings, traffic controls, or staff instructions.

The Company may stop a vehicle, end participation, deny entry, or remove any guest whose conduct violates these Terms or, in the Company's reasonable judgment, threatens safety, disrupts operations, or interferes with other guests' experience. Removal or refusal of admission for these reasons will not result in a refund.

Right to Refuse Admission or Remove Guests

The Company reserves the right to refuse admission, suspend participation, or remove any person, without refund, for failure to satisfy admission requirements; violation of these Terms, posted rules, or staff instructions; unsafe, threatening, disruptive, abusive, or unlawful conduct; suspected intoxication or impairment; or any condition that reasonably presents a safety or operational concern. The Company may contact law enforcement or emergency services when appropriate.

Photography, Video, Audio, and Publicity Release

The Event may be photographed, filmed, livestreamed, or otherwise recorded. By entering the Event, you consent to the capture and use of your name, likeness, appearance, voice, image, photograph, video, audio, statements, and vehicle by the Company and its designees in any lawful media now known or later developed, worldwide, in perpetuity, without notice, inspection, approval, royalties, or other compensation, for advertising, promotional, publicity, editorial, archival, social-media, or commercial purposes. To the fullest extent permitted by law, you release the Released Parties from claims arising from those authorized uses, including claims for privacy, publicity, or misappropriation.

A parent or legal guardian attending with a minor provides this consent for the minor to the fullest extent permitted by law. Nothing in this section authorizes the Company to use a person's identity in a false, defamatory, or unlawful manner.

Ticket Purchaser and Occupant Responsibility

The ticket purchaser is responsible for providing these Terms to every driver and occupant covered by the purchase before arrival. Each adult driver or occupant independently accepts these Terms by entering the Event property or participating in the Event. A purchaser may accept these Terms for another person only when the purchaser has legal authority to do so.

The purchaser and driver are responsible for ensuring that every occupant complies with the admission requirements, safety rules, and staff instructions. If any occupant does not agree to these Terms or cannot safely participate, that person must not enter the Event.

Minors

Guests under 18 years of age must be accompanied by a parent or legal guardian. The accompanying parent or legal guardian represents that they have authority to supervise the minor and consent to the minor's participation, accepts responsibility for monitoring the minor, and agrees to these Terms on their own behalf and, to the fullest extent permitted by law, on behalf of the minor.

Weather, Delays, Changes, and Cancellation

TERROR FALLS is a rain-or-shine event. The Company may delay, suspend, shorten, relocate, reroute, modify, reschedule, or cancel all or part of the Event because of severe weather, equipment failure, utility interruption, emergency conditions, government orders, staffing or safety concerns, acts of God, or other circumstances beyond the Company's reasonable control. Attraction elements, performers, effects, and operating procedures may change without notice.

Refund and Exchange Policy

ALL TICKET SALES ARE FINAL. NO REFUNDS, CREDITS, OR EXCHANGES WILL BE ISSUED EXCEPT AS REQUIRED BY APPLICABLE LAW OR AS EXPRESSLY ANNOUNCED IN WRITING BY THE COMPANY.

No refund, credit, or exchange will be provided for General Admission and/or TERROR PASS tickets because of rain or ordinary weather conditions; fear or dissatisfaction with the attraction; inability or decision not to participate; late arrival, missed entry time, or failure to attend; medical or sensory sensitivity; closure or modification of individual effects or attraction elements; refusal of admission; or removal for violating these Terms or Event rules. The Event is rain or shine. The TERROR PASS is valid for unlimited access for admission October 10, 17, 24, 31 2026 for during the TERROR FALLS HAUNTED CARWASH EVENT ONLY. TERROR PASSES will be assigned to, and is valid for admission ONLY on, the tag of the vehicle at the time of purchase. TERROR PASSES are non-transferrable and PARADISE FALLS CAR WASH, LLC reserves the right to revoke entry, TERROR PASS, and/or admission for misuse, attempted misuse, alterations or any other reason not pursuant to its intended use or terms.

Governing Law and Venue

These Terms and any dispute arising out of or relating to them, a ticket, or attendance at or participation in the Event shall be governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any legal proceeding shall be brought exclusively in a state court of competent jurisdiction located in the Georgia county where the Event is held or in the United States District Court having jurisdiction over that county, and each party consents to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or, if necessary, severed, and the remaining provisions shall remain in full force and effect.

Entire Agreement; No Waiver

These Terms, the ticket terms displayed at purchase, and the Event's posted safety rules constitute the agreement concerning admission and participation. If an Event safety rule conflicts with these Terms, the rule providing greater immediate safety protection controls during the Event. The Company's failure to enforce any provision on one occasion is not a waiver of its right to enforce that provision or any other provision later.

Final Acknowledgment

BY PURCHASING OR ACCEPTING A TICKET, ENTERING THE EVENT PROPERTY, OR PARTICIPATING IN TERROR FALLS, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS; THAT YOU VOLUNTARILY ACCEPT THE RISKS OF ATTENDING A LIVE, DRIVE-THROUGH HAUNTED ATTRACTION; AND THAT YOU AGREE TO THE RELEASE OF LIABILITY AND ALL OTHER TERMS ABOVE.
